Filing of the trademark application

Examination

In this stage, the Intellectual Property Office will review the file, and will determine if the application have met the minimum filing requirements. After this review, the application will be sent to an examination team who will examine it.

This examination will take approximately one month, and will determine if the mark meets all the legal requirements, and also, if there are any conflictive marks towards the proposed mark. If the examiner finds any deficiencies in the application filed, he/she will issue an examination report, in which applicant will have the opportunity to persuade the examiner that the objection(s) are not valid, or to make amendments to the specification of goods and services. The report will inform how much time is there in order to answer this objection.

Publication

If the examination concludes that the application fulfills the requirements established by law, or if the application has overcome any objections, the application will be published in the Trademark Journal. From the publication date, third parties have a two month term in order to file oppositions based on the belief that the published application might be detrimental to their rights. This period can be extended to 3 months by anyone considering opposition.

Acceptance

If no opposition is filed, or filed oppositions are unsuccessful, trademark will get registration, and its owner will be free to use and enforce the trademark.

Duration of the registration

The protection of a registered trademark will last for ten years, and will be calculated from the date in which the trademark application was filed. The renewal application can be filed as early as six months before the expiration date, and could be renewed in a maximum term of six months from the expiration date.
